For reference these terms are used throughout these Terms and Conditions and have specific meaning. These meanings are defined below:

1. Clantoolz Accounts
Accounts
Each User undertakes to Start an Account using his/her own correct name, address, and other requested details. In the event that any such information changes the User must notify Clantoolz.com immediately of such change.

User Names and Passwords
Each User will choose a user name and password upon sign-up for use of the Services, which will be confirmed by Clantoolz.com. This user name and password is personal to the User. The User is responsible for all access to the Web Site and use of the Services using that user name and password. The User shall not disclose any user name, password or other security information supplied by Clantoolz.com to any third party.

2. Changes to the Web Site and it's Major Services
Changes by Clantoolz.com
The User acknowledges and accepts that Clantoolz.com may from time to time alter or terminate any aspect of the Web Site, or any of the services or products provided through the Web Site, as it thinks fit and without prior notice to the User. The User accepts that it will have no claim for breach of contract or otherwise in respect of any such alteration. Clantoolz.com reserves the right to e-mail members at their e-mail address regarding any major service issues and it will be presumed that such e-mails will have been read. Clantoolz.com may run automated searches for abuse of its Services and members are deemed to have accepted this limited intrusion to their networks or machines.

Clantoolz reserves the right to update these terms without notice.

3. Privacy
Clantoolz.com operates a strict privacy policy with regard to private or personal information supplied by our members and will not sell or pass on any private member details to any third party organization unless that User specifically asks us to. From time to time Clantoolz.com will collate the information into general statistics, however this will be very general and not detail specific members.

4. User Conduct
The User warrants that in its use of the Web Site it shall:

not act in any manner which negatively impacts on the community, equipment or network of Clantoolz.com or is likely to lower Clantoolz.com in the larger Internet community. use the Web Site only for lawful purposes, and in a manner which does not infringe the rights of, or restrict or inhibit the use of the Web Site by any third party not engage in any conduct which is unlawful, or which may harass or cause distress or inconvenience to any person or in any way degrade the Clantoolz clan community as a whole. This includes using a clansite for any purpose that is contrary to the best interests of this multiplayer gaming community and will be interpreted and enforced at Clantoolz sole discretion. not engage in other activities that contradict the normal function of a clan website nor contradict Clantoolz expectation for this service business. not upload, post, transmit or distribute any material or information in which the User does not own the intellectual property rights, or any material which is in any way unlawful or which is potentially harmful, threatening, abusive, libellous, pornographic, preditory, or otherwise obscene, or racially or ethically or otherwise objectionable; and not assist in the sending of unsolicited e-mails or run an open mail relay of any kind. not upload, post, transmit or distribute any material or information which contains a computer virus, or other code, files or programs intended or having for effect to disrupt or otherwise adversely affect the operation of the Web Site or of other Users' computer systems. be aware that in using Clantoolz.com they may travel over other networks or be involved in the use of other services. Users must be aware that they will be bound by the Terms and Conditions imposed by the operators of these networks and services.

5. Games Conduct
Users Conduct
When playing organised matches, Users must act in a sportsmanlike manner at all times. Malicious behaviour will not be tolerated, neither will cheating (i.e. using "bots" or "hacked pak files").

6. Non Compliance with Terms and Conditions
Effect of Failure to comply
Failure to comply with any Terms and Conditions may find the User being subject to, but not limited to:

• A formal warning.
• Suspension or removal of one or all of a member's services.
• Termination of a User's membership to Clantoolz.com.
• A ban from competing in any game play, tournaments, and/or any other player or clan/team events (length of the ban will be determined by Clantoolz.com Officials)

Any decision made by Clantoolz.com with regards a User's failure to comply will be final and all cases will be considered individually upon their merits.

7. Use of Cookies
Storage of Cookies in Users Computer System Clantoolz.com use both persistent (or stored) cookies and session cookies to improve the functionality of its web site. Stored cookies are used to provide features such as "My Clan". The cookies on any user machine hold the information for the users Clan Homepage. If users switch off stored cookies the site may work, but features such as these will not function. Clantoolz.com use Session cookies when any user logs on to a web based service, Rent.A.Server scheduling or a Clantoolz Account for example. If users don't have Session cookies enabled, they won't be able to logon.

8. Service Refunds
All Credit Card and Token transactions through Clantoolz.com are final. This is due to the nature of Clantoolz Services and Products overall. Since most if not all Products and Services at Clantoolz are extremely low in dollar value, it is likely that the costs involved in refunding any one transaction would be cost prohibitive and actually be more than the original transactions themselves. Because of this it is our belief that we will best serve our customers and ourselves by maintaining a no refund policy at this time. We also believe that there are exceptions to every rule, although this rule is adhered to stringently. You are always welcome to make a request to Clanhelp -- at -- Clantoolz.com.

9. Product Refunds
Although all Credit Card and Token transactions are final with no refunds, we will accept requests for Return for Replacement of items bought at our online store. All requests will be considered on a customer by customer basis. Please send all RFR requests to Clanhelp -- at -- Clantoolz.com, include your order number and the reason you need a replacement.

10. Service Outages
Computer and Telecommunications Faults
The user acknowledges and accepts that computer and telecommunications systems are not fault free and may from time to time require periods of downtime (being periods during which the Web Site is not available to the User) for the purposes of repair, maintenance and upgrading. Accordingly Clantoolz.com does not guarantee uninterrupted availability of the Web Site, but it shall make reasonable effort to minimise any periods during which the Web Site is not available. The User accepts that he or she shall have no claim for breach of contract or otherwise in respect of any such period of unavailability.

Copyright and other Intellectual Property Rights The User acknowledges that all copyright, trademarks (registered or unregistered), know-how, design rights (registered or unregistered) and all other intellectual property rights in the Material, the Web Site and the Services shall belong to Clantoolz.com and the User undertakes not to infringe any of the said rights. Other than to the extent required to access and view the Web Site, no copying, distribution, modification of the Web Site or any Material is permitted. Resale or supply of any Material is expressly prohibited. Clantoolz.com accepts no responsibility for the content of any postings by Users and retains the right to remove any posting which, in its opinion, is in breach of these Terms and Conditions. Users shall not advertise any products, services or refer to specific web site addresses without obtaining consent of Clantoolz.com. Users will only post material which they own in copyright and must not infringe the rights of any third party including (but not limited to) copyright, trade mark, trade secret, privacy or publicity rights. As a user, you will agree to indemnify Clantoolz.com against any damages, loss, costs or expenses arising from any posted material, including but not limited to any claim by any third party that such use infringes its intellectual property rights.
